Variance Request
A resident may apply for a variance for the proposed construction if the construction or remodel project does not comply with the CC&Rs because of an unusual physical condition of the property.
Please refer to Pima County Code § 18.93.030. Variances for details on valid reasons for requesting a variance.
If plans have already been submitted for review by the Architectural Review Committee, the following information must be submitted to complete the variance application process:
Name of property owner and appropriate contact information
Address of property
Lot number
Letter justifying an exception to the CC&Rs (not based on the needs of the owner but on a physical condition of the property)
If plans have not been received by the Architectural Review Committee for review, please submit the following:
Name of property owner and appropriate contact information
Address of property
Lot number
Letter justifying an exception to the CC&Rs (not based on the needs of the owner but on a physical condition of the property)
Current “As-Built” Survey completed by a registered surveyor locating all existing improvements including, but not limited to, house, garage, patios, ramadas, guest homes, sheds, pools, hardscape, walls, fences, and solar installations (“As-Built” Survey not required if building on a vacant lot)
Site Plan of the entire property showing the location of the new construction, proposed exterior remodeling, any existing structures, and other improvements on the property, and the 30-foot setback lines
Floor Plan or Plan of new construction, additions, exterior remodeling, and any other improvements
Elevations showing the architectural style and clearly indicating the proposed heights above grade, finish materials, and location of any architectural features
Color samples of paint or descriptions of other finish materials in the form of a plaster color chip or paint chip or a description of the materials if they are a natural material, e.g. burnt adobe or clay tile
Landscape and/or Revegetation Plan
Upon receipt of a variance request, the Board will send letters, describing the requested variance to all contiguous surrounding neighbors requesting their written support of the requested variance. The neighbors will have 15 days to respond to the Board’s letter. If all contiguous neighbors state that granting a variance would not adversely affect the value of their property, the Board will then vote on the variance and if granted, will record the Notice of Variance with Pima County.
Please note: Approval of a variance request is not an architectural approval and it is still subject to municipal zoning approval.
